1. Scope of Application

The following T&Cs apply to all orders via our online shop by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity. An entrepreneur is a natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

With regard to entrepreneurs, the following applies: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with warm-on GmbH.

By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided for this purpose in the order process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order, you will receive another confirmation by email.

4. Requirements and Handling of Customer Content

4.1 Requirements

If it is necessary for the fulfillment of the order that you submit content to us (e.g. texts, data, files), the existing technical options for this and the applicable requirements depend on the respective product description.

You are solely responsible for the content, including the legality and correctness, of the content you submit. We do not carry out any editorial review of the content before executing the order.

4.2 Compliance with Applicable Law

The content and the products to be created from it must always comply with the respective applicable legal regulations. In particular, they must not violate any rights and claims of third parties (in particular, copyright, trademark, or other protective rights), and must not contain or serve any glorification of violence, discrimination, racism, xenophobia, or other immoral or unconstitutional content.

4.3 Indemnification

You indemnify us against claims by third parties that they may assert in connection with an infringement of their rights through the contractual use by us. You also assume the necessary costs of legal defense, including all court and attorney fees in statutory amount. The indemnity does not apply to the extent that you are not responsible for the infringement. In the event of a claim by third parties, you are obliged to provide us with all information immediately, truthfully, and completely, which is necessary for the examination of the claims and a defense.

4.4 Right of Withdrawal

We reserve the right to reject the order or to withdraw from the contract if the content provided by you for this purpose violates legal or regulatory prohibitions or good morals, or if there is a justified suspicion to this effect. This applies in particular if constitutionally hostile, racist, xenophobic, discriminatory, insulting, youth-endangering, and/or glorifying violence content is provided.

We ship the products to the delivery address specified in the order process.

We only deliver by mail. Unfortunately, self-collection of the goods is not possible.

In our shop, the following payment methods are generally available to you.

Advance Payment
If you choose the payment method advance payment, we will give you our bank details in a separate email and deliver the goods after receipt of payment.

Credit Card
In the ordering process, you enter your credit card details. Your card will be charged immediately after placing the order.

Amazon Pay
To pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by Amazon Pay within one banking day after the order has been placed.

Amazon Pay can offer registered and , according to its own criteria, selected Amazon Pay customers further payment modalities in the customer account. However, we have no influence on the provision of these modalities; any additional payment modalities offered individually concern your legal relationship with Amazon Pay. Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.

Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is available with the respective payment option and in the ordering process.

Klarna Credit Card
You enter your credit card details in the ordering process. Your card will be charged immediately after placing the order by Klarna. No address and credit check will be carried out.

Klarna Direct Debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you about the date of debiting your account (so-called pre-notification). The account will be debited after the goods have been shipped.

Klarna Pay Later
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum rate is €6.95.

Klarna can offer registered and, according to its own criteria, selected Klarna customers further payment modalities in the customer account (e.g. interest-free installment plans). However, we have no influence on the provision of these modalities; any additional payment modalities offered individually concern your legal relationship with Klarna. PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. Further information is provided during the ordering process.

PayPal can offer registered and, according to its own criteria, selected PayPal customers further payment modalities in the customer account. Direct Debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal about the date of debiting your account (so-called pre-notification). The account will be debited before the goods are shipped.

Invoice Purchase via PayPal
Purchasing on account via PayPal requires an address and credit check and is made directly to PayPal.

Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, authenticate yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is available during the ordering process.

7. Right of Withdrawal

You have the statutory right of withdrawal as described in the cancellation policy.

8. Retention of Title

The product remains our property until full payment is made.
For entrepreneurs: We reserve ownership of the product until all claims from an ongoing business relationship have been settled in full. You are allowed to resell the reserved goods in the ordinary course of business; all claims resulting from this resale are hereby assigned to us in advance, irrespective of any connection or mixing of the reserved goods with a new item, and we accept this assignment. You are authorized to collect the claims, but we may also collect them ourselves if you fail to meet your payment obligations. We will release the securities due to us at your request to the extent that their realizable value exceeds the claims to be secured by more than 10%.

9. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please complain about such defects as soon as possible to the delivery company and contact us immediately. The failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance company.

We are always liable for claims due to damages caused by us, our legal representatives, or vicarious agents

  • in the event of injury to life, body, or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of guarantee promises, if agreed, or
  • if the scope of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. In all other respects, claims for damages are excluded.

The European Commission provides a platform for online dispute resolution (OS), which you can find here. Consumers have the opportunity to use this platform to settle their disputes.

In order to settle disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. 14. Final Provisions

If you are a merchant, German law applies excluding the UN Sales Convention.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.

If individual clauses of these terms and conditions are or become invalid in whole or in part, the remaining provisions of the contract remain valid. To the extent that individual clauses are invalid, the content of the contract shall be governed by statutory provisions.
